Spousal Maintenance

Spousal Maintenance Laws in Arizona

For spousal maintenance, or alimony, in Arizona, the courts establish support levels according to a number of factors. A few of these are:

  • Income
  • Health of the former spouses
  • Length of the marriage
  • Ability of the spouse receiving support to provide for themselves

If one parent is the sole caregiver of the couple’s child or children and cannot work outside the home because of those responsibilities, the other spouse may be ordered to pay spousal support.

These factors are all taken into account, but ultimately the judge decides spousal support amounts.

How Long Does Alimony Last?

A judge determines how long one person pays spousal maintenance to another based on the circumstances of each individual’s situation. How long would it take for the spouse receiving maintenance get the education necessary to be back on the job market and support themselves? Again, the duration of the marriage is also factored into the order.

Despite clarity of the statutes and court responsibilities, divorcing parties often disagree about what is fair and appropriate for both sides. You need a lawyer who can help you understand the law and your options.
